Electoral Act: S’Court strikes out FG’s suit
THE Supreme Court, yesterday, struck out the suit filed by President Muhammadu Buhari and Attorney General of the Federation (AGF’s), Abubakar Malami, to challenge Section 84 (12) of Nigeria’s Electoral Act has been struck out.
The Supreme Court on struck out the suit in a judgement delivered by a seven-justice panel of the apex court, yesterday.
Ruling that “no political appointee at any level shall be a voting delegate or be voted for at the convention or congress of any political party for the purpose of the nomination of candidates for any election,” Supreme Court also held that “the case is an abuse of court process.”
It will be recalled that President Buhari and Malami had on April 29 filed a suit at before Supreme Court, seeking an interpretation of the controversial clause in the Electoral Amendment Act 2022.
